1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and Digital Marketing Stream LLC (“Company,” “we,” “us,” or “our”) governing your access to and use of https://digitalmarketingstream.com (the “Site”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Site immediately.

2. Nature of the Site and Services

The Site provides informational content relating to marketing strategy, advertising, connected TV (CTV), artificial intelligence applications, digital media, website intelligence, and related business topics. Content published on the Site, including blog posts, newsletters, insights, educational materials, and AI-assisted user experiences, is provided for general informational purposes only.

Your use of the Site does not create a client, advisory, fiduciary, or professional relationship with the Company. Professional services offered by Digital Marketing Stream LLC, including consulting, strategy, campaign management, advisory work, and related services, are governed exclusively by separate written agreements executed between the Company and each client. In the event of any conflict between these Terms and a signed services agreement, the signed services agreement shall control.

3. No Professional, Legal, Financial, or Performance Guarantees

Nothing on this Site constitutes legal, financial, investment, tax, cybersecurity, compliance, or other professional advice. You should consult qualified professionals before making legal, financial, technical, or operational decisions.

Marketing, advertising, and business performance depend on numerous factors, including budget, timing, competition, audience behavior, market conditions, internal execution, third-party platform changes, and algorithmic systems outside our control. The Company makes no guarantees regarding revenue, lead volume, return on ad spend, search visibility, campaign results, conversion rates, or business growth.

4. Third-Party Platforms, Systems, and Services

The Site and the Company’s services may reference, integrate with, rely on, or interact with third-party platforms, systems, and service providers, including but not limited to Google, Meta, LinkedIn, AWS, analytics providers, email platforms, streaming and advertising platforms, website tools, and artificial intelligence technologies.

We are not responsible for third-party outages, account restrictions, policy changes, data-processing practices, algorithm changes, platform suspensions, content-moderation decisions, pricing changes, service interruptions, or performance fluctuations caused by external platforms or systems. Your use of such third-party services remains subject to their own terms, policies, and practices.

5. Intellectual Property

7. AI, Aura™ by Digital Marketing Stream, and Audio Experience

The Company may use artificial-intelligence tools, automation systems, analytics platforms, and Aura™ by Digital Marketing Stream, our on-site intelligence layer, to support website functionality, content navigation, and informational user experiences.

Responses generated through Aura™ by Digital Marketing Stream, along with any AI-assisted audio or “listen to this page” functionality, are created exclusively from approved on-site content, knowledge paths, and first-party materials designated by Digital Marketing Stream LLC. These features are provided for informational convenience only and should not be relied upon as legal, financial, business, strategic, or professional advice.

While the Company uses commercially reasonable controls to maintain source integrity, AI-assisted outputs and audio renderings may occasionally contain omissions, interpretation errors, or outdated references. The written page content on the Site remains the official system of record. Users are responsible for independently verifying important decisions before relying on any AI-assisted response or audio playback.

User-submitted inquiries, messages, or interactions may be processed through secure third-party service providers for operational, hosting, analytics, delivery, or support purposes.

8. Privacy and Data Handling

Your use of the Site is also subject to our Privacy Policy. By using the Site, you acknowledge that information may be collected, processed, and stored in accordance with our Privacy Policy and applicable law.

9. Limitation of Liability

If liability is established notwithstanding the foregoing, the total liability of Digital Marketing Stream LLC to you for any and all claims shall not exceed one hundred dollars ($100 USD). Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you to the extent prohibited by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Digital Marketing Stream LLC, its affiliates, officers, representatives, contractors, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the Site, your violation of these Terms, your violation of applicable law, or your infringement of any rights of another party.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts, and you consent to the personal jurisdiction and venue of such courts.

12. Changes to These Terms

We reserve the right to update, revise, or modify these Terms at any time in our sole discretion. Changes become effective upon posting to the Site unless otherwise stated. Your continued use of the Site after revised Terms are posted constitutes your acceptance of those updated Terms.
